Donrey Capital Bureau CARSON CITY -- The Judicial Discipline Commission has filed disciplinary charges against a Mineral County justice of the peace accused of interceding in a criminal case affecting his friends. The commission contends Justice Randy Varain of Schurz Township interceded in a case affecting David Wayne Musselman. He improperly arranged for Musselman's release from jail and assisted in reassigning his case, according to the commission.
Varain also is both friend and employer to Musselman's victim, Sheila Washington, and her mother Bonnie Hughes, the commission contends. The complaint filed Saturday charges Varain with violating judicial canons. Though he was disqualified from the case, Varain allegedly worked to reassign the case to another justice of the peace after the initial justice had reached a plea bargain settling the case. He now has an opportunity to respond to the charges filed by the commission. The commission has the authority to remove, censure or fine a judge.
