Former guard withdraws lawsuit against Siegfried

A former security guard and attendant to Roy Horn withdrew his lawsuit against Horn's stage partner Siegfried Fischbacher on Monday, saying the litigation had achieved its goal of publicizing his concerns about the injured entertainer's quality of health care.

"It was never about the money. It was about trying to get Mr. Roy some help," said Louis Mydlach, 34, of the lawsuit he filed against Fischbacher in October, claiming wrongful dismissal and emotional distress. Mydlach claimed Fischbacher mistreated his stage partner and improperly medicated him during Horn's rehabilitation from a tiger bite and subsequent stroke.

The lawsuit "did what it was supposed to do, it got some light on the subject," Mydlach said Monday. The lawsuit attracted national media coverage.

Mydlach had publicly asked to meet with Horn, with whom he worked closely in the year after Horn's accident in October 2003. Mydlach said Monday the meeting never came off.

Mydlach filed a motion to dismiss his case without prejudice, meaning he can refile it in the future.

A motion to dismiss the lawsuit filed by Fischbacher's attorney claimed Mydlach's behavior became "unprofessional and increasingly disturbing" before the magicians terminated the security service owned by Mydlach's father, James. That motion was scheduled for hearing on Dec. 8.
