SON'S SUICIDE: Father agrees to plea deal

News of agreement upsets mother

The father of a 12-year-old boy who fatally shot himself has agreed to enter into a plea agreement amid allegations he left loaded weapons unsecured throughout his house.

Authorities said Geoffrey Wells, 36, is likely to receive probation in connection with the suicide of his son, Syber.

"I was shocked," said Maria Wells, mother of the boy and estranged wife of Geoffrey Wells.

"No one even called me to tell me there was a plea deal," she said. "I think they (authorities) have just shown the public it's OK to leave loaded weapons around your house."

Prosecutors said the terms of the deal are stiffer for Geoffrey Wells than in similar cases involving tragedies caused by unsecured firearms used by children.

"In truth, there is no amount of punishment that could be imposed on a father compared to the grief he will suffer, knowing for the rest of his life his actions played a role in his son's death," District Attorney David Roger said.

A woman who answered the phone at the office of Geoffrey Wells' attorney, Gerard Bongiovanni, said he had no comment on the matter.

Authorities said Syber Wells shot himself on Aug. 26 at his father's Henderson home on West Basic Road. The boy and his two younger brothers were the subject of a custody dispute in Family Court.

Maria Wells said she recorded a video of the unsecured guns in her estranged husband's house shortly before she left him.

She said she tried to show the video to Family Court Judge Cheryl Moss, who was presiding over the proceedings, but Moss never watched the tape.

Moss ordered Geoffrey Wells to secure his guns when the children were visiting, and she ordered the couple to share temporary joint legal custody.

After the suicide, Moss was criticized for her handling of the case.

Police searched Geoffrey Wells' home and found nine firearms, all of them unsecured. Clark County prosecutors charged Geoffrey Wells with felony child abuse neglect in September.

In Henderson Justice Court on Tuesday, Geoffrey Wells waived his right to a preliminary hearing and indicated he is willing to plead guilty in District Court to one gross misdemeanor count of neglect.

He faces up to three years of probation if Judge Donald Mosley accepts the plea Nov. 1.

Roger said that Geoffrey Wells has agreed to plead guilty to a gross misdemeanor and that in similar cases, defendants have pleaded guilty to misdemeanor charges.

Last year, Gil and Rolema Reeder were charged with neglect after their son, Jake, accidentally shot and killed friend 14-year-old Dustin Osborn with a handgun.

The two boys were playing unsupervised at the Reeders' Henderson apartment, and charges were brought against the parents after they told investigators they routinely left a .45-caliber pistol on the kitchen counter when their son was home alone.

The Reeders pleaded no contest to a misdemeanor charge, and they received probation.

In another case last year, Francisco Javier Cervantes-Perez was charged with neglect after leaving an unsecured handgun in an apartment filled with teenagers.

Erica Mendoza, was fatally shot by her brother, 15-year-old Rocky Mendoza.

Cervantes-Perez pleaded no contest to a misdemeanor charge and received probation.
