Judge ordered to explain not taking ethics course

CARSON CITY -- The Commission on Judicial Discipline ordered District Judge Donald Mosley to attend its Dec. 7 meeting and explain why he has not taken a required ethics course.

Commission Chairman Steve Chappell said Mosley was fined $5,000 in March 2002 and ordered to attend the next ethics course at the National Judicial College in Reno.

Chappell said the state Supreme Court upheld Mosley's punishment in January 2005.

While Mosley has paid the fine, the commission has "no proof on file" that he "attended the first available course, or any course, for that matter." He was told to appear at the commission's Dec. 7 meeting in Las Vegas to explain his actions.

The discipline was imposed against Mosley for using his judicial position to gain an advantage in a child custody fight. For years, Mosley has been in a custody battle with Terry Mosley, the mother of his 13-year-old son.

Their dispute has been so rancorous that Mary Boetsch, a lawyer for the commission, said during the Supreme Court hearing on the case that it likely would not end until the boy turns 18.
