Mother allowed visitation

Woman accused of killing foster child granted visits with own children

Melanie Ochs, the mother accused of killing her foster child, on Wednesday received visitation rights to see her own two children daily.

District Judge Nancy Saitta said Ochs will be able to see her 2-year-old and 3-year-old from 4 p.m. to 6 p.m. A court order had prohibited her from seeing her children after she was arrested more than two months ago on a charge of murder.

Prosecutor Vicki Monroe asked that Ochs remain on house arrest until her trial, but did not argue against the visitation rights.

"She's been just biding her time praying for this day for two months," said Robert Langford, Ochs' defense attorney.

Ochs is accused of killing "Baby Boy Charles," a 7-month-old foster child in her care who died from blunt force trauma to the head on Aug. 4. Authorities determined the injury was not accidental.

Langford said the father, Laurence Tokarski, has had custody of the two children and has been caring for them at the family home with the help of Ochs' mother.

Ochs was not in court Wednesday.

Langford said Ochs is living in an apartment complex separate from the family home, as required by a court order.

She plans to get a full-time job at the start of the new year, he said.

Langford went to Family Court earlier this month to ask for the visitation. He said a psychologist recently evaluated Ochs' two children and determined that "being away from mom was having a detrimental impact on them psychologically and developmentally."

The Family Court hearing master recommended the daily two-hour visits but required Saitta's approval first.

The murder trial is expected to go forward May 14.
