Roberto Ortega was killed over birthday cake.

Las Vegas police said the 33-year-old was shot to death during a birthday and Halloween party on Oct. 29 in the 200 block of Samantha Street, near Nellis Boulevard and Stewart Avenue.

They said Ortega was shot to death by a 15-year-old after a fight erupted at the party when the teen began throwing cake at people inside the house.

Richard Eugene Henley was booked into the Clark County Detention Center on Tuesday as an adult and charged with murder with a deadly weapon and two counts of attempted murder.

Henley, formerly a student at Las Vegas High School, was arrested last week by police but remained at the Clark County Juvenile Detention Center until authorities certified him as an adult.

Police said Henley went to the party with several friends, dug his fingers into a birthday cake and threw it at Ortega's wife, which started a fight in the house.

Ortega and several others chased Henley out of house. As Henley was fleeing, he fired several shots and hit Ortega and two other men, police said. Ortega died, another man was shot and was in critical condition, and a third was shot in the leg.

Ortega's mother, Antonia Ortega, 52, who lives a block away from him, said she heard the gunshots and ran to her son's house.

The mother, who expressed relief when told police had arrested a suspect, said she found her son bleeding near the side of the house. She first thought he was dead, but he had a pulse. He later died at University Medical Center.
