Trucker had three speeding tickets in '05

Violations led California authorities to impose probation

The truck driver jailed for last week's quadruple fatal crash on Interstate 15 had a rash of traffic violations in 2005, prompting California officials to put his driver's license on probationary status, according to records in that state.

In January, the California Department of Motor Vehicles put Milson Sabino Oliveira Filho's driving privileges on one year of probation after he racked up six violation points against his commercial driver's license. The violations included three convictions for breaking the state's 55-mph speed limit for tractor-trailers, according to the DMV.

"I think it's an indication of a problematic trend in the industry," said Lawrence Smith, who is representing the family of three of the crash victims. "These guys get paid for moving stuff, and they try to get it there as fast as possible."

The Nevada Highway Patrol said the 51-year-old's truck, filled with 80,000 pounds of paper products, was going at least 60 mph Thursday night when it plowed into slow-moving traffic entering a construction zone on southbound I-15 near Cheyenne Avenue in North Las Vegas.

The pileup involved 13 vehicles. Three adults and one child were killed, and five other people, including an infant, were injured.

Killed in the crash were 31-year-old Robert Allen Newsted Jr., 69-year-old Arturo Torno Cortez, his 64-year-old wife, Estrellita Cortez, and their 7-year-old granddaughter, Kayla Cortez.

The Cortezes were driving to McCarran International Airport to pick up a relative for Thanksgiving, Smith said.

Oliveira ("filho" means "son" in Portuguese and is attached to the end of Brazilian names like "Jr." is in English) was arrested and booked on four counts of felony reckless driving causing death, two counts of felony reckless driving causing injury and four counts of involuntary manslaughter.

He remained jailed at the Clark County Detention Center on Tuesday in lieu of $500,000 bail.

Oliveira, a self-employed trucker based in Southern California, told authorities he was unable to stop because his brakes locked up.

Oliveira has a history of traffic violations in California. According to California DMV records, he was convicted of speeding in his truck in July, November and December 2005. Each conviction tacked 1.5 points against Oliveira's commercial driver's license.

He was docked another 1.5 points in September 2005 for failing to comply with a vehicle inspection, the DMV said.

The six-point total in less than 12 months prompted the one-year probation on his license. According to the DMV, a probation also carries a six-month suspension, but it was unclear on Tuesday whether California had suspended Oliveira's license.

Within the past three years, Oliveira was also cited for exceeding weight limits on his tractor-trailer and driving his truck outside of a restricted lane, the DMV records show.

He had also been cited three times in the past year for brake problems on his trucks, according to federal transportation records.

Oliveira's lawyer, Jeff Segal, said he did not know of his client's traffic troubles.

"If he had some tickets in the past, I don't think that would have any bearing on what happened in this case," Segal said.
