Chaz Higgs is scheduled on Monday to appear in a Hampton, Va., court, where authorities could decide to extradite him back to Nevada, a jail official said Saturday.
Higgs was arrested Friday on charges of first-degree murder in the death of his wife, former state Controller Kathy Augustine, and is being detained at the Hampton city jail in Virginia.
The jail official, who declined to be identified, said Higgs will make his first court appearance at the General District Court in Hampton. The official declined to comment further.
Higgs, 42, is accused of killing Augustine, 50, in July by injecting her with a muscle relaxant.
He previously told authorities that Augustine suffered a heart attack brought on by stress even though she was in good health. Augustine was campaigning for state treasurer at the time of her death.
Higgs was arrested in Hampton, where he had been staying with relatives.
At Monday's hearing, Higgs could agree to be extradited and then would be returned to Nevada, Reno Police Department Lt. Jon Catalano told the Reno-Gazette Journal. He said that if Higgs fights extradition, it would take about 10 days to get a governor's warrant.
According to a police report, Higgs, who worked as a critical care nurse at Carson-Tahoe Regional Medical Center, told a co-worker that he was having marital problems and was planning on ending his relationship.
Commenting on a high-profile murder case, Higgs told the co-worker in July that if he was going to murder someone, he would administer succinylcholine, a muscle relaxant that he believed is undetectable after death, the report states.
Augustine's urine tested positive for succinylcholine.
Cheri Glockner, a hospital spokeswoman, said last week that Higgs had been employed at the hospital for just three weeks and did not return to work following his wife's death.
Glockner confirmed the hospital stocks succinylcholine, but said there have been no reports of missing vials of the drug.
