Nevada high court to hear Desai appeal in April
The Nevada Supreme Court has set an April 5 hearing in Dr. Dipak Desai's appeal to overturn his criminal conviction in the deadly hepatitis C outbreak.
All seven justices will hear a combined half-hour of arguments from both sides at the Regional Justice Center in Las Vegas.
A jury convicted Desai in July 2013 of 27 criminal counts related to the hepatitis outbreak, including second-degree murder in the death of infected patient Rodolfo Meana, 77.
Desai, 66, is serving a life prison sentence with the possibility of parole after 18 years.
In April he pleaded guilty in federal court to conspiracy and health care fraud charges stemming from the 2007 outbreak and later was sentenced to a concurrent 71-month prison term.
Authorities have said unsafe injection practices during medical procedures at Desai's now-closed endoscopy clinic in Las Vegas led to the hepatitis outbreak, considered one of the state's worst-ever medical calamities.
Desai gave up his medical license after authorities disclosed the outbreak in early 2008.
