Theater text messages spur class-action lawsuit

A Florida man filed a class-action lawsuit Tuesday that accuses V Theater Group and Las Vegas producer David Saxe of invading his privacy by sending him unsolicited text messages.

According to the lawsuit, plaintiff Bijan Razilou believes the class members “number in the thousands, if not more.” He is represented by Las Vegas attorneys Dennis Kennedy and Paul Williams.

Messages left for Saxe on Wednesday were not returned.

Razilou filed the lawsuit in U.S. District Court in Las Vegas against V Theater Group LLC, David Saxe Productions and its owner, Saxe.

According to the complaint, the defendants directed the mass transmission of text messages to cellphones nationwide in an attempt to reach potential customers.

Razilou called a box office operated by the defendants in December to get seats for the Nathan Burton Comedy Magic show in the Saxe Theater at Planet Hollywood Resort. Before providing requested contact information, according to his lawsuit, he told the representative he did not wish to get marketing calls or materials.

“He was assured that such marketing efforts would not be made,” the lawsuit alleges.

According to the complaint, the defendants violated the Telephone Consumer Protection Act.
