To try to jump-start the stalled construction-defects litigation, CityCenter has asked the Nevada Supreme Court for a quick hearing and decision on a key lower-court ruling that went against it.
Last year, Clark County District Judge Elizabeth Gonzalez decided that CityCenter, managed and half-owned by MGM Resorts International, could not use a sampling it had conducted to determine how much of the unfinished Harmon Hotel was marred by faulty workmanship. This would cause CityCenter to engage in more structural testing to claim monetary damages for the alleged full loss of the building.
In the brief filed with the Supreme Court on Wednesday, CityCenter raised the concern, as it has before, that the Harmon could collapse in a serious earthquake. This added an impetus to the court acting quickly, CityCenter wrote in court papers.
General contractor Perini Building Co. commissioned a study last year that said installing eight temporary pillars to shore up the Harmon at key spots would alleviate the earthquake threat. This job would take about two months to complete for an estimated $2 million.
