Gang figure accused of rape

An associate of the Rolling 60s Crips who served time for a racketeering conspiracy conviction is back in jail after he was arrested on allegations he raped his mentally challenged teenage daughter.

Federal prosecutors said Todd Davis, 36, also admitted to smoking marijuana after his 2007 release from prison, a violation of conditions attached to his supervised release.

Davis appeared in federal court Monday while prosecutors and his defense attorney argued whether he should remain in jail until a formal revocation hearing on Feb. 4.

U.S. Magistrate Judge George Foley ordered Davis to remain in custody.

Assistant U.S. Attorney Michael Chu said Davis failed a November 2008 polygraph test during which he was asked three questions related to having sex with his 19-year-old daughter. The daughter, who Chu said has the mental capacity of a 14-year-old, had reported an incident to authorities.

After she alleged the rape, she called Davis' probation officer and recanted the story, Chu said.

"How does she get that telephone number? How does she know who to call?" Chu asked, suggesting that Davis threatened his daughter.

The prosecutor said Davis probably would continue to instill fear in the victim if he were released from jail before a trial on the charges.

Federal Public Defender Rebecca Rosenstein said Davis denies raping his daughter. Rosenstein suggested the detailed accounts of sexual activities the daughter provided authorities might have come from experiences she had with her boyfriend, who is much older.

Davis was one of 21 men charged in a 2003 federal indictment that targeted the Rolling 60s. A two-year investigation led to the indictment that brought charges against 21 men, including Davis.

Davis, who was known as Demarlo Luscious, pleaded guilty in 2004 to a racketeering conspiracy charge and was sentenced to nearly five years in prison. He was released in June 2007.
