MOTORIST ALERTED POLICE
Man found fatally shot on side of rural road
A man who was fatally shot was found by detectives on the side of a rural eastern Las Vegas Valley road Saturday night, according to the Metropolitan Police Department.
The man, whose identity was not released, was most likely dumped there after he was shot in the upper torso, Homicide Lt. Lew Roberts said Sunday.
Police discovered the body shortly after 10 p.m. near Lake Mead Boulevard and Pabco Road.
Roberts said police don’t have any suspects. No witnesses have come forward.
Roberts said a motorist who saw the body alerted police.
"There’s no reason for him to be out there," Roberts said of the shooting victim. "We’re talking a couple miles outside of the city."
Roberts said the victim might have been on the side of the road about 12 hours before police arrived.
The case is the fourth homicide of 2009 within the jurisdiction of Las Vegas police.
Seal ruled invalid on Gibbons divorce case
A Family Court judge handling the divorce case of Gov. Jim Gibbons has ruled that the Nevada statute keeping the case under seal is unconstitutional.
Judge Francis Dougherty on Friday set a 60-day period for arguments over what portions of the divorce case should remain sealed.
The case had been sealed last year at Gibbons’ request, but his wife’s attorney Cal Dunlap moved over the summer to have it unsealed.
Dunlap argues the governor violated an agreement to not speak publicly about the case by giving an interview about the divorce.
Gibbons’ attorney, Gary Silverman, said he would confer with the governor to decide whether they would appeal the ruling to the Supreme Court of Nevada.
The governor filed for divorce in May, citing incompatibility.

Utility fined $49,000 for discharges in river
A Truckee-area utility has been fined $49,000 over its discharges into the Yuba River.
The Central Valley Regional Water Quality Control Board contends the Donner Summit Utility District exceeded limits on nitrates and ammonia in treated effluent discharged into the South Yuba River.
Utility officials say they were slapped with $24,000 in fines for eight violations and $25,000 in discretionary penalties stemming from an algae bloom that occurred on the Yuba River last summer.
Utility officials say other factors may have contributed to the algae bloom and they’ll try to negotiate the $25,000 discretionary penalty down.
Gary Reedy of the South Yuba River Citizens League says the utility should be forced to make improvements before expanding.
Reedy says excessive nitrogen levels in the Yuba River can lead to a reduction in trout and an increase in invasive species.
Police officer kills man brandishing sword
A man wielding a samurai sword was shot and killed by a police officer in downtown Modesto, Calif., early Sunday.
Modesto police spokesman Sgt. Brian Findlen said the 44-year-old man was seen acting strangely and brandishing the two- to three-foot long sword outside a hotel shortly after 5 a.m.
A police officer was sent to the scene but it was not immediately clear whether the man charged the officer or what led her to shoot him, Findlen said.
