A judge issued an order Monday that stopped Nevada’s sex offender law from taking effect until challenges are resolved.
U.S. District Judge James Mahan said he was concerned that if the law had gone into effect Tuesday as planned, low-level sex offenders would be incorrectly and publicly identified on the state’s sex offender Web sites. They could not regain their anonymity if the law is found unconstitutional, he said.
The federal challenge to the law was brought by the American Civil Liberties Union of Nevada and attorney Robert Langford on behalf of 12 sex offenders. They argue that the law punishes sex offenders for crimes they already paid for and is cruel and unusual punishment.
