ELKO — A Nevada judge isn’t cutting the eight-to-20-year sentence for a 27-year-old Elko man convicted in 2006 in the starvation death of his 7-month-old daughter.

A lawyer for Florencio Carlos Uribe promised to appeal to the Nevada Supreme Court to overturn Uribe’s conviction on a felony charge of child abuse or neglect with bodily harm, according to the Elko Daily Free Press.

Elko District Court Judge Mike Memeo ruled against Uribe on Wednesday.

Uribe’s wife, Salvana Fernandez, 27, was found guilty in 2010 of child abuse or neglect causing substantial bodily harm in the 2005 death of Monica Uribe. The conviction came after several trials.
