Ousted NLV official loses appeal
The Nevada Supreme Court has rejected a claim by a former North Las Vegas city manager that the city violated the state open meeting law when it dismissed him from his position in 2003.
Kurt Fritsch sued the city, claiming the City Council violated his right to due process, breached his contract and violated the open meeting law in a 5-0 vote to oust him.
Fritsch lost his case in Clark County District Court and then appealed.
In the decision issued Tuesday, the Supreme Court rejected Fritsch’s claims.
While the agenda item that lead to Fritsch’s termination did not state that he might lose his job, the description: “Discussion and Possible Action on City Manager’s Contract” was sufficient to meet the requirements of the state open meeting law, the court said.
Fritsch’s other claims also were dismissed by the court.
