No prosecution in tour bus rollover

KINGMAN, Ariz. -- Authorities in northwest Arizona have decided there's no reason to prosecute a tour bus driver involved in an Oct. 17 accident that claimed the lives of two tourists from China.

After reviewing a report of the accident investigation, Deputy Mohave County Attorney Jace Zack declined to press charges at this time.

"There is no evidence of any alcohol or drug use by the driver," Zack wrote in a memo to the Sheriff's Office. "The conduct of the driver going off the pavement does not constitute a gross deviation from the standard of care necessary for manslaughter or negligent homicide charges."

Zack's memo also stated that the bus driver did not exceed the posted speed limit.

Two people were killed and eight other passengers were injured when the mini-tour bus operated by California-based TBE International Inc. rolled over on Pierce Ferry Road, en route to the Sky Walk at Grand Canyon West. The bus had departed from Las Vegas.

Zack noted that he could revisit the possibility of prosecution if new evidence surfaces during the next six months.
