Simpson lawyers ask justices to reconsider denial of robbery appeal

O.J. Simpson's defense attorneys have asked the state's high court to reconsider their denial of the former football great's appeal of his robbery and kidnapping conviction.

Attorney Yale Galanter filed a petition Tuesday with the Supreme Court stating the three justices who heard the original appeal misapprehended or overlooked his arguments.

The petition is asking that the same three justices -- Michael Cherry, Mark Gibbons and Nancy Saitta -- hear the arguments again.

Simpson's appeal focused on several issues, including dismissal of the only two black potential jurors in the final stages of jury selection. Galanter argued they were removed by prosecutors because of their race.

Simpson also appealed Judge Jackie Glass' denial of a jury instruction regarding intent and the armed robbery charge. Simpson's lawyers argued that he was simply recovering what he thought was his own property when he went to the hotel room.

The court rejected the arguments as "without merit."

Simpson, 63, is serving a nine- to 33-year prison sentence at Lovelock Correctional Center, a medium-security facility near Reno, according to the Nevada Department of Corrections.

Simpson was convicted in 2008 of kidnapping, armed robbery and other charges for what he maintained was an attempt to recover heirlooms on Sept. 13, 2007.

If the court denies Simpson's petition, he could then petition to have all seven justices hear his appeal.

The Supreme Court last month overturned the conviction of Simpson's co-defendant, 56-year-old Clarence Stewart, granting him a new trial.
