Ex-eTreppid employee files suit

The man accusing Gov. Jim Gibbons of accepting kickbacks from a Reno software company is suing his former attorney for fraud, court papers state.

Former eTreppid employee Dennis Montgomery filed the lawsuit this month in Los Angeles Superior Court, claiming his former attorney, Michael Flynn, misled him into believing he was a California-based lawyer.

Flynn is licensed to practice law in Massachusetts.

In response, Flynn called Montgomery's lawsuit a "sham" and asked that it be dismissed, court papers state.

Montgomery's allegations are "so fully fabricated" that he and his attorneys should be sanctioned, Flynn said in court papers.

Flynn questioned Montgomery's credibility and said the software designer filed the suit only to get out of paying hundreds of thousands in legal fees.

"Mr. Flynn is currently owed over $600,000 dollars. (The) complaint is a disguised attempt to dishonestly defeat payment of those fees," Flynn stated.

Flynn declined to comment Wednesday.

Montgomery's new attorney, Deborah Klar, could not be reached for comment.

In early July, Flynn asked to withdraw as Montgomery's attorney, citing Montgomery's behavior and lack of payment.

Montgomery has accused Gibbons of accepting bribes from Warren Trepp, founder of eTreppid, in exchange for steering millions in military contracts to the company.

Those allegations prompted a federal investigation into Gibbons. Gibbons has denied the accusations.

Montgomery is currently in a federal civil lawsuit with Trepp over ownership of software used by the military.
