Castle doctrine
Nevada would be much better off if most bill drafts requested by state lawmakers never saw the light of day.
Take Assemblyman Harry Mortensen's recently submitted measure to create "the Office of State Paleontologist."
How did this great state survive so long without one?
Not all proposals are bad, however. Another of Mr. Mortensen's bill drafts for the 2009 session would clarify that Nevada homeowners have a right to defend themselves with deadly force in the face of an intruder.
At least 15 states have already adopted the so-called "castle doctrine" in recent years, which states homeowners do not have to retreat in the face of a break-in.
Thankfully, Nevada's police agencies and district attorneys have generally exhibited common sense, usually opting against trying to prosecute individuals who use force to protect their lives and property in the face of a potentially violent criminal. But Mr. Mortensen's legislation would add an extra level of protection for those forced into such unfortunate situations.
And that's good.
