O'Bannon sues NCAA over use of images

Former UCLA basketball player Ed O'Bannon is suing the NCAA over its use of former student athletes' images in DVDs, video games, photographs, apparel and other material.

In a federal lawsuit filed Tuesday in San Francisco, O'Bannon said the NCAA illegally has athletes sign away their rights to the commercial use of their images and does not share proceeds from their use with former athletes.

The lawsuit seeks unspecified damages and calls on the NCAA to pay the former athletes what it has allegedly made from the use of their images. That amount has yet to be determined, said Megan Jones, a partner with the law firm of Hausfeld LLP, which is representing O'Bannon.

It also seeks an injunction on behalf of current student athletes barring the NCAA from licensing the rights to their images.

Bob Williams, a spokesman for the NCAA, declined to comment on the suit, saying the NCAA had yet to review it.

O'Bannon, 36, recently was hired as the boys basketball coach at Henderson International. He works in marketing and sales at Findlay Toyota in Henderson.

Also: Rockets center Yao Ming had surgery in Houston to repair a broken bone in his left foot.

Surgeons grafted bone onto the tarsal navicular bone and realigned his foot to reduce stress on the repair. Yao is expected to miss the 2009-10 season.

Free-agent forward Sean May agreed in principle to a one-year contract with the Sacramento Kings. Terms weren't disclosed.

May had appeared in only 82 of 328 games since being picked 13th in the 2005 draft because of knee and conditioning problems.

Free-agent forward Matt Barnes agreed to a two-year contract with the Orlando Magic. Terms weren't disclosed.

Barnes averaged a career-high 10.2 points, 5.5 rebounds and 2.8 assists in 77 games last season for the Phoenix Suns. The Magic will be his seventh team in his seven NBA seasons.

Toronto introduced guard Jarrett Jack after signing him to a $20 million deal for four years. The Raptors signed the restricted free agent to an offer sheet July 13, and the Indiana Pacers didn't match it.

Jack is one of 11 NBA players who appeared in all 82 games in each of the past two seasons. He averaged a career-high 13.1 points, 4.1 assists and 3.4 rebounds last season.

The Philadelphia 76ers signed guard Jrue Holiday, their first-round draft pick. He averaged 8.5 points, 3.8 rebounds and 3.7 assists as a freshman at UCLA before declaring for the draft.

Former Memphis Grizzlies and University of Memphis point guard Antonio Burks remains in critical condition a day after being shot during a robbery in Memphis, Tenn. Burks, 29, underwent surgery Monday night after he was shot in the lower torso.

Goodell keeps timetable on Vick under wraps

NFL commissioner Roger Goodell isn't revealing when he'll decide whether to reinstate Michael Vick now that the former Atlanta Falcons star quarterback has been released from federal custody.

"The process is ongoing, and I hope to make a decision sometime in the near future," Goodell said, a day after Vick's home confinement ended.

He wouldn't define what "near future" means.

Vick served 23 months on a dogfighting conviction.

Also: Singer Marc Anthony has bought part of the Miami Dolphins, about a month after owner Stephen M. Ross sold another portion of the NFL team to singer Gloria Estefan and her husband, producer Emilio Estefan.

Veteran offensive lineman Jeremy Newberry, signed by the Atlanta Falcons in June, retired from the NFL. The 33-year-old injured his left knee working out.

Contrary to reports, MMA's Leopoldo alive

A mixed martial arts fighter who some media outlets reported had died overnight has come forward to prove that he's alive.

The Orange County, Calif., Sheriff's Department fielded about 200 calls Tuesday about the reported death of Kimo Leopoldo. But the 41-year-old Costa Mesa resident, who once fought in the UFC, said at a news conference he didn't know where the rumor of his death started.

He said he spent the night at a friend's house and was rustled from bed by his promoter, who told him about the reports.

Also: An independent drug test on Jeremy Mayfield was negative for methamphetamines, contradicting the results of a NASCAR test taken 40 minutes earlier, the driver claimed in court documents filed in Charlotte, N.C.

In response to NASCAR's claim that Mayfield again tested positive for methamphetamines on July 6, Mayfield submitted an affidavit to the U.S. District Court that said he traveled to Frye Regional Medical Center in Hickory, N.C., right after NASCAR collected a sample at his Catawba County home.

Mayfield said in the court filing he received confirmation from Laboratory Corporation of America in Raleigh, N.C., that his sample was negative on July 10 -- the same day NASCAR informed his counsel that its sample was positive.

Six investor groups have expressed interest in taking over promotional rights for the historic and financially troubled Milwaukee Mile racetrack, officials said.

With NASCAR and the Indy Racing League poised to post their 2010 schedules soon, any deal would have to come soon. Officials said they hope to receive formal bids by Friday.

Andy Roddick's first action since his loss to Roger Federer in the Wimbledon final will come at the Legg Mason Tennis Classic from Aug. 2 to 9 in Washington, D.C. Roddick has been bothered by a right hip flexor injury.

The Wranglers agreed to terms with forward Chris Neiszner, the first player signed by Las Vegas for the 2009-10 season. He recorded career highs in goals (20), assists (21) and points (41) last season for the team.

Tom Daley of Britain became the youngest diver to win a world title in men's platform when the 15-year-old captured the 10-meter event at the world championships in Rome.
