The Las Vegas attorney has also been accused of plotting with felons to kill a client, an allegation he denied.
A judge has struck down federal prosecutors’ plan to pursue the death penalty in a Reno case after they said they would not seek capital punishment, then reversed course last month.
A plea deal meant Zaon Collins was not tried criminally for the crash. Collins served 56 days in jail, a sentence that upset the victim’s wife.
The move comes after a public defender said the judge suggested her representation of a client was tied to a non-existent sexual relationship.
