Man pleads guilty in fatal shooting

A 41-year-old man will avoid a possible death sentence after pleading guilty Tuesday in a 2008 fatal shooting outside a pharmacy.
During jury selection for his capital murder trial, Marque Gardeley pleaded guilty to second-degree murder and robbery for the death of 36-year-old Marty Devone James Jacobs, who was killed in March 2008 in the Walgreens parking lot at Tropicana Avenue and Durango Drive.
Sentencing was set for Oct. 31. Gardeley faces 10 years to life in prison.
