Health board won’t revisit coal ash landfill decision
The Southern Nevada Health District won't budge on a complaint by a lawyer for the Sierra Club that more scrutiny is needed before NV Energy proceeds with expanding a coal ash landfill for its power plant near Moapa.
Attorney Dan Galpern argued in a letter to the health board this week that it approved the landfill's expansion on a mesa near the Moapa Band of Paiutes without giving the public a reasonable chance to comment on the "complete draft permit."
"In our view, that action clearly should not be taken in the absence of such public and Board review," Galpern wrote to the board's chairwoman, Linda Strickland.
A response email from board spokeswoman Stephanie Bethel said: "The Board did not make any additional requests or adjustments for those conditions, as it could have. Because the Board had already approved the application, the issue did not require any further approval."
