Lawyer to appeal conviction in mortgage investment scheme

A Louisiana lawyer plans to appeal his conviction in Las Vegas federal court on fraud and conspiracy charges stemming from a mortgage investment scheme that prosecutors say involved more than 220 properties and upward of $50 million in losses.

Defense attorney Michael Fawer said Monday he’ll appeal the jury verdict last Thursday against 37-year-old David M. Mark.

Mark is from New Orleans. He’s free pending sentencing July 29 in U.S. District Court.

U.S. Attorney Daniel Bogden says Mark faces decades in prison and more than $1 million in fines on conspiracy, bank fraud and mail fraud convictions.

Mark was a real estate agent and transaction coordinator at Distinctive Real Estate and Investments.

Company owner Eve Mazzarella was convicted of fraud in December 2011 and sentenced to 14 years in prison.
