Supreme Court refuses to join fray over sewer project funds

The Nevada Supreme Court has declined to hear a challenge of a state Legislature effort to siphon $62 million from Southern Nevada sewer project funds for the state budget.

In a one-paragraph order issued Wednesday, the state's only appellate court said the matter should first be heard in a District Court.

The case stems from a refusal by the Henderson-based Clean Water Coalition and businesses including the M Resort to turn over the money after a special session of the Legislature on an
$805 million budget crisis.

The coalition and casino argued that the state lacks authority to take money from an account funded by ratepayers for a specific purpose: Southern Nevada clean-water projects
