Man tries to sue Applebee’s for burning self on fajitas while praying

You know when restaurant servers place a dish in front of you and warn, “Be careful, it’s hot”? Well, this guy has apparently never heard of this common eatery practice.
Hiram Jimenez of Westhampton, N.J., tried to sue Applebee’s after he burned himself on a sizzling skillet of fajitas while he was trying to pray.
To the customer’s dismay, an appellate panel will not hold the restaurant at fault as the dish presented an “open and obvious” danger, USA Today reports.
Because, you know, fajitas.
When Jimenez bowed his head in prayer, the man reportedly heard “a loud sizzling noise” proceeded by “a pop noise” which caused a burning sensation on his face.
Jimenez says the waitress failed to warn him that the dish was hot, but the two-judge panel ruled in favor of Applebee’s, saying the burning was caused by the man’s own negligence as the danger was “self-evident.”
