Huge CityCenter jury trial still on track for Feb. 10

The massive CityCenter construction jury trial will stay on the schedule for a Feb. 10 start.

On Friday, Clark County District Judge Elizabeth Gonzalez turned down a request by several contractors and CityCenter, managed and half-owned by MGM Resorts International, to delay it again. There have already been nine start dates in the case and had the original one stuck, the trial would already be several months old.

The delay was warranted, the attorneys said, by the hundreds of thousand of pages of evidence that need review and dozens of witnesses that need to be deposed. Gonzales, however, noted that the pace of work in both categories has been relatively slow for the past two years.

George Ogilvie III, the attorney for general contractor Tutor Perini Building Corp. opposed the delay. “No matter how much time is given for discovery and trial preparation, lawyers are always going to feel they haven’t had enough time,” he said.

CityCenter attorney Mark Ferrario held out the hope that the trial might take eight to 14 months instead of the feared two years, if certain settlements fall into place.
