Man says he shot girlfriend when she wouldn’t stop nagging

A 43-year-old Oregon man is on trial for murder and his lawyer said he shot his girlfriend by accident when he was trying to stop her nagging so he could sleep.

Jurors heard opening statements for Robert Simonson’s murder trial that will determine if he intended to kill Kimberly Staack, 52, Halloween night in 2013, according to the Medford Mail Tribune.

“This is not a whodunnit,” defense attorney Donald Scales said. “We’re not looking for the real killer here. The issue is what was his intent when he fired that gun.”

A prosecutor told jurors the victim was a “mean drunk” who badgered Simonson before he fired a warning shot, then fired a shot into her head.

The first witness in the case is expected to be called Tuesday.
