Man shot at weekend party at home owned by retired judge

A 19-year-old man was shot in the face early Sunday morning after a gun accidentally discharged during a “party with underage drinking” at retired District Judge Donald Mosley’s home, Las Vegas police confirmed Monday.

The party was hosted by Mosley’s son, Michael, according to a police report. The younger Mosley, who has had multiple scrapes with the law, did not speak with police after the shooting because he could not be located, the report said.

Officers went to the retired judge’s home at 1127 Westlund Drive, near Charleston Boulevard and Rancho Drive, at 2:18 a.m. on a report of a sick or injured person. The retired judge was not present, police said.

Police identified the person holding the gun before it went off as Brandon Jackson, 18. The injured man was identified as 19-year-old Kyle Divicino. His condition was not known Monday night. He was treated at Sunrise Hospital and Medical Center after the shooting.

The report said Divicino and Jackson went into a room with guns in it. Jackson was “messing with one of the guns” when it went off.

“The round went into the left cheek of Divicino,” the report said.

Sgt. John Sheahan said Monday afternoon that no one was arrested in connection with the shooting. Police have spoken with the parties directly involved in the incident.

“There is no crime. No arrests and no prosecution in this case,” Sheahan said. “The victim is not pressing any charges.”

Neither Donald nor Michael Mosley could be reached for comment Monday night.

Clark County property records show the home where the shooting occurred is owned by the Mosley Donald M. Family Trust.

Police spokesman Bill Cassell said Monday night he did not know of any citations or arrests related to the underage drinking mentioned in the report.

Michael Mosley is no stranger to law enforcement.

In December 2011, Mosley, then 19, was arrested on a reckless driving charge. The Nevada Highway Patrol nabbed him in the misdemeanor driving violation. He had outstanding warrants for registration violations, unlawful acts of financial responsibility and three parking violations, records show.

In 2008, Michael Mosley faced criminal charges for his role in a Henderson crash that left a 15-year-old girl dead. Prosecutors dropped manslaughter charges because of lack of evidence.

He was 16 when he was accused of racing David Jensen, also 16. Jensen crashed, and passenger Olivia Hyten was killed.

Prosecutors charged Michael Mosley with driving under the influence and possession of a switchblade knife. His parents said his blood-alcohol content was 0.02 percent, the equivalent of consuming less than one beer.

Jensen crashed the Chevrolet Silverado pickup on a winding stretch of road on Grand Hills Drive. Hyten was partially thrown from the truck and died.

At the time, Michael Mosley was under court order to drive only to and from school and was prohibited from carrying other passengers in his truck. The court order stemmed from a previous reckless driving case.

Donald Mosley retired in 2012 after 33 years on the bench.
