Dannon will pay $21 million to states to resolve complaints

Yogurt giant Dannon Co. on Wednesday said it will pay $21 million to the attorneys general of Nevada and 38 other states to settle claims of unsubstantiated and illegal marketing claims for its Activia yogurts and DanActive dairy drinks.

The attorneys general said they worked with the Federal Trade Commission on the investigation.

The attorneys general said Dannon made unsubstantiated claims that Activia could improve digestive health and that DanActive dairy drinks could give consumers "immunity," and help prevent colds and flu.

Nevada will receive $425,000 as its share of the multistate settlement.
