Wynn breaks with nightclub mogul after arrest with Hilton

Wynn Las Vegas announced Wednesday that it has cut ties with a nightclub mogul after he was arrested on suspicion of driving under the influence of alcohol with celebrity socialite Paris Hilton on Friday night and has banned Hilton from its properties.

Cy Waits was stopped by a motorcycle officer who said he smelled "a strong odor of marijuana" coming from Waits' 2009 Cadillac Escalade on the Strip near the Wynn Las Vegas hotel and casino.

Las Vegas police believe they found a "roach," or a used joint of marijuana, in the vehicle, according to Waits' arrest report. Waits' girlfriend, Hilton, also was in the vehicle and later was arrested for felony cocaine possession.

On Wednesday, a spokeswoman for Wynn announced that Waits is "separated from the company and is free to pursue other interests." Waits, along with his twin brother, Jesse, was a managing partner of the nightclubs Tryst and XS. Jesse Waits will continue as general partner of the nightclubs.

Hotel developer Steve Wynn also banned Hilton from his Las Vegas properties after her arrest, a company spokeswoman confirmed Wednesday.

Waits' arrest report said he failed several impairment tests, including swaying while balancing, using his arms to balance, and was not able to stand on one leg without putting his foot down.

Waits also had bloodshot eyes, his breath smelled of alcohol, and he was wobbling, the report said. He was polite, cooperative, and submitted to a blood test, according to the report.

The report said police found "a 'roach,' white piece of rolled paper w/ green leafy sub inside. It was wet + unable to be tested." Police found Zig-Zag-brand rolling papers in Hilton's possession, the report said.

Waits' attorney, Richard Schonfeld, said Wednesday that he was "troubled by the arrest," because he believes the officer didn't observe any traffic infraction or other indication that Waits was impaired. Schonfeld added that Waits passed the Horizontal Gaze Nystagmus field sobriety test, which tests the eyes.

But according to the arrest report, Waits failed two other field sobriety tests.

And arresting officer Michael Polion wrote in the report, "I could smell marijuana coming out of the vehicle, pulled up to passenger side and driver stated he just got done smoking."

Waits, 34, was arrested on a misdemeanor charge of driving under the influence of alcohol or drugs. He spent the night in jail before he was released on $2,000 bail with a Nov. 29 court date.

Hilton, 29, was arrested on one felony count of cocaine possession after a police lieutenant discovered a baggie of cocaine when she opened her purse to retrieve lip balm and the plastic baggie fell out. Hilton claimed the cocaine wasn't hers.

Hilton was freed without bail before dawn Saturday after spending less than three hours handcuffed on a jailhouse booking room bench. She is scheduled to appear before Las Vegas Justice of the Peace Joe Bonaventure on Oct. 27.
