Former and current Cosmopolitan of Las Vegas workers allowed to join lawsuit
A U.S. District Court judge in Las Vegas has ruled that more than 7,000 current and former Cosmopolitan of Las Vegas employees can participate in a wage and overtime lawsuit filed in May 2012.
Judge George Foley Jr. ordered a copy of the federal court notice be mailed on Aug. 30, according to a 32-page ruling released Thursday.
The lawsuit was filed by a former hourly employee who alleges the Cosmopolitan wrongly terminated her when she was eight month pregnant. The former hourly employee, Melodee Megia, and others weren’t paid for all hours worked and were shorted on overtime, according to the lawsuit, which sought class-action status to represent hourly workers.
The pay allegations target a timekeeping system that always rounded work hours in favor of The Cosmopolitan, which is based on 15-minute intervals, meaning employees could lose an hour per day as they punch in and out four times, according to the complaint.
The lawsuit also seeks $70 million for employees who, according to company documents, were required to change into and out of company uniforms on site without compensation.
“As a matter of company policy, we do not comment on pending litigation,” the Cosmopolitan said in a statement.
